- Athlete or participant name, age, and grade
- Parent or guardian name, email address, and phone number
- Emergency contact name and phone number
- Medical conditions or allergies
- Signed liability waiver acknowledgment

- Organizational or program information relevant to the scope of services
- Session notes and progress information (stored securely and confidentially)
- Email address from newsletter and mailing list sign-ups
- Name and message content submitted via contact forms
- IP address, browser type, and usage data through analytics tools
Payment transactions are processed securely by Stripe. We do not store credit card numbers or full payment details on our servers.
How We Use Your Information
- Process and manage event registrations, program enrollments, and service agreements
- Deliver 1:1 athlete development, mental performance, parent training, and coaching services
- Communicate session details, program updates, and confirmations

Information About Minors
Practiced collects personal information about minors (athletes ages 14–18) solely through their parent or legal guardian. By submitting a registration or enrollment form, the parent or guardian confirms they have legal authority to provide the minor's information and consent to participation on their behalf.
We do not knowingly collect personal information directly from children under the age of 13 without verifiable parental consent. If we learn we have collected information from a child under 13 without proper consent, we will delete that information immediately. How We Share Your Information
We do not sell your personal information. We may share your information in the following limited circumstances:
- Event Operations: We share necessary registration information with event staff and check-in personnel for the purpose of managing camp and program operations.
- Service Providers: We use Jotform, Squarespace, Stripe, and email marketing platforms. These providers access your information only to perform services on our behalf.
- Legal Requirements: We may disclose your information when required by law, court order, or governmental authority.
- Business Transfers: In the event of a merger or sale of assets, your information may be transferred as part of that transaction.
Confidentiality of Client Information
Information shared during 1:1 sessions, consulting engagements, and program participation is treated with strict confidentiality. We do not share individual session content, personal disclosures, or organizational information with third parties without your express written consent, except as required by law.
Please note that Practiced provides behavior-based consulting, development, and performance services. We are not a licensed mental health treatment provider. If clinical mental health services are needed, we will provide appropriate referrals.
Your Rights

- Right to Correction: Request that we correct inaccurate information.
- Right to Deletion: Request that we delete your personal information, subject to certain legal exceptions.

Data Retention & Security
We retain personal information only as long as necessary for the purposes outlined in this policy or as required by law. Registration and program data is retained for two years following the completion of services. You may request deletion at any time by contacting info@wearepracticed.com.
We implement reasonable administrative, technical, and physical security measures to protect your personal information. However, no method of internet transmission is 100% secure.
Changes to This Policy
We reserve the right to update this Privacy Policy at any time. We will notify you of significant changes by posting the updated policy on our website with a revised effective date.

Agreement to Terms
These Terms and Conditions constitute a legally binding agreement between you and YAYA KERSEY LLC, operating as Practiced, governing your access to and use of wearepracticed.com and all related services, events, programs, and products.
Services include but are not limited to: Return to the Brick Basketball Camp, The Mental Edge Series, 1:1 athlete mental performance training, parent training, coach education and development, organizational culture consulting, group development sessions, speaking engagements, digital products, and merchandise.
By accessing our website or using our services, you confirm that you have read, understood, and agree to be bound by these Terms.
Intellectual Property
All content associated with Practiced — including the Practiced name, P mark logo, The Practiced Method, AWE (Athlete Wellness Ecosystem) framework, written content, curricula, graphics, and methodologies — is the proprietary property of YAYA KERSEY LLC and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, modify, license, or commercially exploit any content without our express prior written permission.
Scope of Services & Limitations
Practiced provides behavior-based consulting, athlete development, mental performance coaching, and organizational culture services. These services are developmental and consultative in nature — they are not a substitute for licensed mental health treatment, medical care, or clinical therapy.
- N'Kayah Kersey, MS, BCBA operates in a consulting and coaching capacity through Practiced. Services rendered do not constitute a clinical therapeutic relationship.
- If clinical mental health services are needed, we will provide appropriate referrals to licensed providers.
- Results from our services are not guaranteed. Outcomes depend on consistent engagement, implementation, and effort.
Events & Camp Registration
- Registration information must be accurate and complete
- A parent or legal guardian must complete registration on behalf of any minor participant
- Participation in athletic activities involves inherent physical risks
- Practiced, YAYA KERSEY LLC, and event co-hosts are not liable for injuries, illness, or damages sustained during participation
- Photos and videos may be taken during events and used for promotional purposes unless you notify us in writing prior to the event
- We reserve the right to remove any participant for conduct that is unsafe, disruptive, or violates these Terms
Programs & 1:1 Services
- You will provide accurate information during intake and throughout the engagement
- Program content, materials, and session notes are proprietary and confidential
- For programs involving minors, a parent or legal guardian must provide consent prior to services commencing
- Practiced reserves the right to terminate services if engagement is harmful, unproductive, or violates these Terms
Consulting Engagements
- Scope, timeline, and deliverables will be outlined in a separate service agreement or proposal
- All proprietary organizational information shared during consulting engagements is treated as confidential
- Practiced retains ownership of all frameworks, methodologies, and materials developed or used in the delivery of services
- Client organizations may not reproduce or internally train staff on Practiced methodology without a separate licensing agreement
Cancellations & No-Shows
- There are no cancellation fees for individual sessions or program appointments
- If you need to cancel or reschedule, please notify us at info@wearepracticed.com as soon as possible
- Cancellations after enrollment in group programs do not entitle you to a refund
- If you miss a scheduled session without prior notice, we will make every reasonable effort to reschedule at a mutually convenient time
- Repeated no-shows without communication may result in forfeiture of remaining sessions at our discretion
Refund Policy
If you are unable to attend, please notify us at info@wearepracticed.com so we may offer your spot to another athlete.
All sales are final. No refunds will be issued once a cohort has commenced or access to program materials has been granted. Requests for credit toward a future cohort may be considered before a program begins.
All sales are final once services have commenced. Unused prepaid sessions may be applied to rescheduled appointments but are non-refundable.
All merchandise sales are final. Exchanges may be considered for manufacturing defects within 7 days of receipt.
Confidentiality
Information shared during 1:1 sessions, group programs, and consulting engagements is treated with strict confidentiality. Practiced will not disclose personal, organizational, or session-specific information to third parties without your express written consent, except as required by law.
Participants in group programs are expected to maintain confidentiality regarding other participants. Sharing another participant's disclosures outside of the program is a violation of these Terms.
Limitation of Liability
To the fullest extent permitted by applicable law, YAYA KERSEY LLC, its officers, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability to you for any claim shall not exceed the amount paid by you, if any, for the specific service giving rise to the claim.
Governing Law
These Terms shall be governed by the laws of the State of Florida. For events held in New Jersey, applicable New Jersey law shall also apply. Any legal action shall be brought in the appropriate courts of Orange County, Florida.
